Is this not discrimination?

Quran and Scholars’ Answer: Dr. Zakir Naik has provided a beautiful and logical explanation for this. In Islam, the entire financial responsibility of the family (housing, food, medical care) rests solely on the man (whether as a father, brother, husband, or son). On the other hand, a woman has no obligation to spend her earned or inherited wealth on her family. At the time of marriage, she receives ‘Mahr’ (dowry/gift) from her husband, and after marriage, her husband bears all her expenses.

The brother, who receives 2 shares of the property, must use it to maintain himself, his wife, and his children.

The sister, who receives 1 share, gets to keep it entirely as her personal wealth (savings), which she does not have to share with anyone.

It is due to this vast difference in financial responsibilities that this rule of distribution is kept, which is actually more beneficial for the woman.

AI Creates Much, But One Thing It Can Never Make

2. Why is polygamy for men and monogamy for women?

(Regarding Polygamy) Demographic Reality: Due to wars, accidents, and occupational hazards, the mortality rate of men is naturally higher than that of women. As a result, the number of women in society naturally exceeds that of men. If multiple marriages were not permitted, this massive number of women would be deprived of a respectable family life or would become victims of illicit relationships.

2. Saving Society from the ‘Mistress’ System (Sociological): In modern societies where polygamy is illegal, there is a higher tendency among men to have extramarital affairs or keep a ‘mistress’. In such relationships, the woman has no legal or social rights. Islam does not tolerate this hypocrisy. Islam dictates that if a relationship is to be established, the woman cannot be kept in the dark; she must be accepted as a ‘wife’ with full legal rights, Mahr, and honor.

3. Biological and Physiological Reasons: Due to pregnancy, the postpartum period, or menstruation, women require long natural breaks from marital relations. Furthermore, if the first wife is seriously ill or unable to bear children, the husband can respectfully keep her with him instead of divorcing her, and marry another woman. On the other hand, even if a woman had multiple husbands, she could only conceive once a year, so polyandry does not aid in human reproduction.

4. Inheritance and Paternity (Legal & Inheritance): If a woman had multiple husbands, it would have been impossible to prove who the actual father of the child was before the advent of DNA testing. Without paternal identity, the inheritance and wealth distribution system would completely collapse. Moreover, severe legal complications would arise regarding which husband would bear the financial responsibility for the wife.

5. Psychological and Family Discipline: Discipline is essential to run a family smoothly. If a woman had multiple husbands, chaos would ensue over who would lead the family. Additionally, men are naturally very territorial towards their partners. If there were multiple husbands, there would be a high probability of intense jealousy, conflict, and even bloodshed among them.

6. Preventing Exploitation and Moral Decay: When the number of women in society exceeds that of marriageable men, and there is no legal provision for polygamy, many women face financial and social insecurity. Exploiting this, some people treat women merely as objects of consumption, often pushing them toward prostitution or immoral professions. As a result, women lose their true honor, and the youth reach the extreme limits of moral decay, gradually corrupting the entire social system. The permission for polygamy in Islamic law protects women from such exploitation and social degradation.

A Simple and Practical Example: Suppose there are 100 marriageable men and 110 marriageable women in a society. Now, if the society or state strictly mandates that ‘one man can only marry one woman’, after the 100 men marry 100 women, the remaining 10 women will remain unmarried forever.

What is the future of these 10 women in society? They essentially have two paths before them:

They must spend their entire lives in loneliness and insecurity.

Out of the urge to survive or human instinct, they might be forced into a secret relationship with a married man.

In this second scenario, society will label that woman a ‘mistress’ or ‘illegal lover’. That man will use her merely for consumption but will not give her the respect of a wife, legal rights, Mahr, or a valid paternal identity for her child.

Islam’s Solution (Permission for Polygamy): Islam does not indulge in this hide-and-seek, hypocrisy, or exploitation of women. Islam says that if that married man is financially capable and has the ability to be just to his wives, he should not commit sins in secret but should publicly marry that woman as his second wife. As a result, the woman receives the full dignity of a wife, property rights, and her unborn child receives a legitimate paternal identity. Society is also saved from extramarital affairs, prostitution, and moral decay.

In Islam, polygamy is not a tool for a man’s limitless lust; rather, it is a practical ‘safety shield’ to protect womankind and save society from prostitution and moral decay. On the other hand, a woman having multiple husbands destroys the social and family structure, which is why it has been strictly prohibited.

3. Why are two women equal to one man in financial testimony?

Question: According to verse 282 of Surah Al-Baqarah, why are 2 women considered equal to 1 man in witnessing financial transactions?

Quran and Scholars’ Answer: This ruling applies strictly to ‘financial transactions’ or contracts, not to all situations. The Quran itself clearly states the reason: “so that if one of the women errs, then the other can remind her.” In ancient times (and often still today), women were generally not as involved in commerce or complex financial transactions as men. Whenever someone lacks experience in a certain field, the probability of making a mistake is higher. Therefore, this provision was given for the sake of financial security. Dr. Zakir Naik reminds us that in testimonies regarding murder or many other matters, the value of a woman’s and a man’s testimony is equal. In fact, a major part of Islam (the Hadith sciences) is based on the narrations of a single female companion, Hazrat Aisha (R.A.).

4. Is the Veil or Hijab an interference with women’s freedom?

Question: Why do women have to be imprisoned behind a burqa or hijab? Isn’t this a way to suppress them?

Quran and Scholars’ Answer: In Islam, the hijab or veil is not a form of imprisonment or a tool to confiscate freedom; rather, it is a symbol of a woman’s honor, dignity, and security. To understand the hijab in detail, we must deeply analyze the psychological and social reasons behind it:

1. The Veil of Men’s Eyes and Psychology: Interestingly, the Quran speaks about the veil (lowering the gaze) for men before it speaks about the veil for women. Allah says, “Tell the believing men to reduce [some] of their vision and guard their private parts…” (Surah An-Nur: 30). In the following verse, the veil for women is mentioned.

Superficially, one might wonder what the connection is between a man’s gaze and the veil. But thinking deeply from a psychological perspective, the first unwanted attraction or evil thought between men and women originates from the eyes. The eyes are the doors to the mind. When a man restrains his gaze, the primary path to sin or unwanted attraction is closed off. Islam goes to the very root of any problem to provide a solution. Hence, the first step of the veiling system starts with the veil of men’s eyes, and the second with the woman’s veil.

2. Evaluation of Intellect over Outward Appearance: The purpose of the hijab is not to belittle women, but to protect them from the evil gazes and sexual harassment of men with perverted mentalities in society. When a woman is in modest clothing (hijab) instead of tight or revealing clothes, society cannot judge her based on her physical beauty, outward appearance, or figure. Then, society is forced to evaluate her based on her intellect, work, personality, and character. The hijab essentially saves a woman from becoming a cheap ‘commodity’ or an object of consumption in the eyes of society.

3. The Hijab is not for being locked in the house, but for moving forward: Many have a misconception that the hijab means locking women within four walls. In reality, the hijab did not come to keep women sitting at home; rather, it came so they could step outside safely. There is no barrier in Islam to women acquiring education, working, or engaging in social service. The only condition is— modesty (the veil) must be maintained, and character must be kept pure. The hijab is a ‘safety shield’ for women in the outside world, wrapping which she can move forward confidently with her head held high in all spheres.

4. A Practical Example (Plastic vs. Gold): This can be understood with a simple example. Usually, cheap or ordinary things (like stones or pieces of plastic) lie scattered on the streets or in open spaces, which anyone can see or pick up. But highly valuable and precious items, like gold, diamonds, or gems, are always kept safely secured and covered inside a box or carefully stored in a safe so that no dust settles on them and no one casts an evil eye on them.

In the eyes of Islam, a woman is far more valuable than that gold or diamond. Therefore, instead of leaving her exposed to everyone like cheap objects, she is kept protected and honored through the hijab or veil.

5. Is the right to divorce in Islam solely for men?

Question: Why is the power of divorce in the hands of men? Do women not have this right?

Quran and Scholars’ Answer: This is a major misconception. In Islam, both men and women have the right to exit a marriage honorably.

From the man’s side, the separation is called Talaq.

From the woman’s side, the right to seek separation is called Khula.

Since the husband financially provides the Mahr at the time of marriage and bears all wedding expenses, the primary right to Talaq is kept with the man, considering the immediate financial loss. However, if a woman does not wish to stay with her husband, she can easily obtain a divorce through ‘Khula’ via an Islamic court or Qazi.

6. Does the Quran permit beating one’s wife? Prophet Muhammad (PBUH) never raised his hand against any of his wives in his entire life. In his Farewell Pilgrimage sermon and various Hadiths, the outline of this ‘disciplining’ has been provided—it can in no way be a strike that leaves a mark, breaks a bone, or hits the face. According to scholars, this is essentially a ‘symbolic discipline’ (such as a light tap with a miswak or toothbrush), the main purpose of which is not to inflict physical pain, but to express psychological dissatisfaction and make a final attempt to save the relationship from breaking apart.

Conclusion

Before the advent of Islam, female infants were buried alive in Arabia.
